E-Sign Up Terms And Conditions (Business Builder / Consultant)
These E-Sign Up Terms and Conditions (“E-Sign Up Terms”) governs all online applications (“Application”) made to enroll as a Business Builder / Consultant (“Business Builder / Consultant”) of Tupperware Singapore Pte Ltd (“Tupperware”), through the website at https://tupperwarebrands.sg (“Website”). Please read the E-Sign Up Terms carefully before continuing with the Application. By submitting the Application, you shall be deemed to have read, understood and accepted, and shall thereby be legally bound by, the E-Sign Up Terms set out herein. For avoidance of doubt, these are the “E-Sign Up Terms” referred to in the Terms and Conditions of Online Sale at https://www.tupperwarebrands.sg/pages/terms-conditions.
1. CONDITIONS FOR ENROLLMENTYou declare and warrant that you are at least eighteen (18) years of age, and is either a Singapore Citizen or Permanent Resident.
You warrant and confirm that your spouse is not currently, and will not also in the future, be enrolled as a Business Builder / Consultant of Tupperware, even if he or she is, or intends to enroll under an existing Consultant or Director that is different from yours.
You warrant and confirm that all information provided by you to Tupperware must be true and accurate at the point of submission of the Application. You shall update any and all changes to such information as and when applicable.
You warrant and confirm that you have not breached the terms in connection with your registration, establishment, operation, maintenance or use of your “Account” (as the term is defined in and) as stated Terms and Conditions of Online Sale & Accounts.
In the event that any of the above warranties is not or ceases (at any time) to be true, you agree and acknowledge that Tupperware will be entitled to terminate your Business Builder / Consultant immediately on written notice, and that you will have been deemed to waive any accrued rights, privileges or monies owed to you upon termination.
2. PROCESSING OF YOUR APPLICATIONTupperware will endeavour to process your Application within five (5) working days from the date of receipt of your Application. In the event that you do not receive any response from Tupperware within the aforesaid period, please contact Tupperware by e-mail at TWSeOrder@tupperware.com .
Tupperware may in its sole discretion or for any reason, reject your Application.
3. CONTRACT BETWEEN YOU AND TUPPERWAREA contract is made between you and Tupperware to appoint you as Business Builder / Consultant (“Contract”) only when:
(i) you successfully submit your Application;
(ii) you have paid the requisite membership fees at the rates in effect when such fees are incurred (“Fees”); and
(iii) your Application has been approved by Tupperware, whereby a unique consultant ID will be assigned to you by Tupperware through the Website, and notified to you via the email address that you have provided (“Acceptance”).
A. Business HandbookFollowing Acceptance, you will be provided with a link, where you may access or download an electronic copy of the Tupperware Brands Business Handbook (“Business Handbook”). You are encouraged to review and familiarize yourself with the contents of the Business Handbook.
You acknowledge that the Business Handbook is the sole property of Tupperware. The information, logo, artwork, pictures, diagrams, and any other content or material in the Business Handbook are protected by applicable intellectual property laws, including copyright and trade mark laws.
Tupperware reserves the right to modify, update or amend any information in the Business Handbook at any time without prior notice to you.
Unless otherwise provided, you agree that you will not reproduce, republish, upload, post, transmit, or otherwise distribute the contents of the Business Handbook in any way, without the authorisation of Tupperware.
B. Withdrawal before AppointmentYou have the right to withdraw the Contract within five (5) working days from the date of Acceptance (“Withdrawal Period”), without penalty and without giving any reasons, by giving us notice of your intention to do so in writing via e-mail at TWSeOrder@tupperware.com.
If you exercise your right to withdraw the Contract during the Withdrawal Period:
(i) you will not be entitled for any refund of the Fees paid. However, you will be entitled to retain the discount voucher and delivery fee waiver promo code in lieu of the value of the Fees paid; and
(ii) you will be required to destroy all records and copies of the Business Handbook previously provided to you following Acceptance; and
(iii) the Contract will be deemed to have been terminated such that you will be deemed to never have been appointed as a Business Builder / Consultant.
If you do not exercise your right to withdraw from the Contract within the Withdrawal Period, you will be deemed to have accepted all terms and conditions in the Contract and assume all obligations and abide by the terms in the Business Handbook.
4. YOUR ROLE AS A BUSINESS BUILDER / CONSULTANTFollowing Acceptance, and subject to non-withdrawal of the Contract during the Withdrawal Period, you will be enrolled as a Business Builder / Consultant under an existing Consultant or Director.
A. Your ObligationsYou understand and agree that:
(i) you may only make a request to switch to follow another Consultant or Director after three (3) months has elapsed, from the date of acceptance of your Application by Tupperware; and(ii) throughout your term as a Business Builder / Consultant of Tupperware, you shall abide by the terms and conditions in the Business Handbook, including the Code of Conduct detailed therein, which may be updated by Tupperware from time to time.
As a Business Builder / Consultant, you are eligible to subscribe to eTuppLink through your Tupperware Digital Passport (“TuppPassport”), to record all of the sales you have transacted throughout your term as a Business Builder / Consultant of Tupperware, including all transactions made via Tupperware’s e-commerce shop at https://tupperwarebrands.sg, which shall:
(i) entitle you to 25% from the full Retail Price, made from any purchases by your customers through your unique eTuppLink URL– excluding Nett-Priced items and shipping charges ("Retail Profit”);
(ii) be recorded before 11:45pm (Singapore time) on the last day of every month for it to be counted towards the sales commission for that month, failing which, it will be recorded in the following month;
(iii) entitle you to earn commission, subject to your meeting the requirements detailed in the Business Handbook.
For the avoidance of doubt, all sales transacted via eTuppLink based on the guidelines provided in the Business Handbook will be recorded as your personal sales.
You will not be entitled to any commission if your membership is dropped.
5. RELATIONSHIP BETWEEN YOU AND TUPPERWARENeither these E-Sign Up Terms nor your signing up as a Business Builder / Consultant creates any employment, agency, partnership or joint venture relationship between you and Tupperware. You are an independent contractor, and shall be solely responsible for all taxes due on the income earned in connection herewith.
6. PERSONAL DATAYou acknowledge and agree that by providing Tupperware with your personal data in the course of submitting your Application, you hereby give your express consent to Tupperware and/or its group of companies, affiliates, subsidiaries, related companies, associated companies, to collect, use, store, process and/or disclose your personal date, in accordance with the “Personal Data Notice for Tupperware Brands Consultant / Prospective Tupperware Brands Consultant” detailed in the Business Handbook, which may be updated by Tupperware from time to time.
